ส⁠ภ⁠า⁠อุ⁠ต⁠ส⁠า⁠ห⁠ก⁠ร⁠ร⁠ม⁠แ⁠ห่⁠ง⁠ป⁠ร⁠ะ⁠เ⁠ท⁠ศ⁠ไ⁠ท⁠ย (“ส.อ.ท.”) เป็นองค์กรที่ไม่แสวงหาผลกำไร จัดตั้งขึ้นตามพระราชบัญญัติส⁠ภ⁠า⁠อุ⁠ต⁠ส⁠า⁠ห⁠ก⁠ร⁠ร⁠ม⁠แ⁠ห่⁠ง⁠ป⁠ร⁠ะ⁠เ⁠ท⁠ศ⁠ไ⁠ท⁠ย พ.ศ. 2530 มีวัตถุประสงค์เพื่อเป็นตัวแทนของผู้ประกอบอุตสาหกรรมภาคเอกชนในการประสานนโยบายและดำเนินงานระหว่างเอกชนกับรัฐ ส่งเสริมและพัฒนาการประกอบอุตสาหกรรม ให้คำปรึกษาและเสนอข้อแนะนำแก่รัฐบาลเพื่อพัฒนาเศรษฐกิจด้านอุตสาหกรรมของประเทศ และหน้าที่อื่น ๆ ตามที่ระบุไว้ในกฎหมาย

The Federation of Thai Industries (the “FTI”) is a non-profit organisation established under the Federation of Thai Industries Act B.E. 2530 (1987). Its objectives are to represent private-sector industrial operators in coordinating policy and operations between the private sector and the state, to promote and develop industrial operations, to advise and make recommendations to the government for the development of the country's industrial economy, and to perform such other duties as prescribed by law.

โดย ส.อ.ท. เคารพและตระหนักถึงสิทธิความเป็นส่วนตัวของทุกท่าน ที่มาติดต่อ เข้ารับบริการ หรือทำงานร่วมกับ ส.อ.ท. (ต่อไปนี้จะเรียกว่า “ท่าน”) และเพื่อให้เกิดความมั่นใจว่าท่านจะได้รับการคุ้มครองข้อมูลส่วนบุคคล ส.อ.ท. จึงได้จัดทำนโยบายความเป็นส่วนตัวฉบับนี้ขึ้น เพื่อแจ้งใ⁠ห้⁠ท่⁠า⁠น⁠ท⁠ร⁠า⁠บถึงแนวทางในการประมวลผลข้อมูล ข้อมูลส่วนบุคคลของท่านตามที่กฎหมายว่าด้วยการคุ้มครองข้อมูลส่วนบุคคลกำหนด

The FTI respects and recognises the privacy rights of everyone who contacts it, uses its services or works with it (referred to below as “you”). To give you confidence that your personal data is protected, the FTI has prepared this Privacy Policy to inform you of how your personal data is processed, as required by the personal data protection law.

นอกจากนโยบายความเป็นส่วนตัวฉบับนี้แล้ว ส.อ.ท. จะจัดทำเอกสารการแจ้งเตือนการประมวลผลข้อมูลส่วนบุคคลในแต่ละกิจกรรม เพื่อแจ้งให้เจ้าของข้อมูลส่วนบุคคลทราบถึงข้อมูลส่วนบุคคลของตนที่ถูกประมวลผล วัตถุประสงค์และเหตุผลอันชอบด้วยกฎหมายในการประมวลผล ระยะเวลาในการเก็บรักษาข้อมูลส่วนบุคคล รวมถึงสิทธิในข้อมูลส่วนบุคคลที่เจ้าของข้อมูลส่วนบุคคลพึงมี

In addition to this Privacy Policy, the FTI will prepare a privacy notice for each activity to inform data subjects of the personal data being processed, the purposes and lawful bases for processing, the retention period, and the rights that data subjects have in relation to their personal data.

ทั้งนี้ ในกรณีที่มีความขัดแย้งกันในสาระสำคัญระหว่างความในเอกสารการแจ้งเตือนการประมวลผลข้อมูลส่วนบุคคลกับนโยบายความเป็นส่วนตัวนี้ ให้ถือตามความในเอกสารการแจ้งเตือนการประมวลผลข้อมูลส่วนบุคคลของกิจกรรมนั้น

Where there is a material conflict between the terms of a privacy notice and this Privacy Policy, the terms of the privacy notice for that activity shall prevail.

1. คำนิยาม

1. Definitions

1.1 ข้อมูลส่วนบุคคลPersonal Data

ข้อมูลเกี่ยวกับบุคคลซึ่งทำให้สามารถระบุตัวบุคคลนั้นได้ไม่ว่าทางตรงหรือทางอ้อม แต่ไม่รวมถึงข้อมูลของผู้ถึงแก่กรรมโดยเฉพาะ

Information relating to a person that enables the identification of such person, whether directly or indirectly, but excluding information of a deceased person in particular.

1.2 ข้อมูลที่มีความอ่อนไหวSensitive Personal Data

ข้อมูลส่วนบุคคลตามมาตรา 26 แห่งพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 ซึ่งได้แก่ ข้อมูลเชื้อชาติ เผ่าพันธุ์ ความคิดเห็นทางการเมือง ความเชื่อในลัทธิ ศาสนาหรือปรัชญา พฤติกรรมทางเพศ ประวัติอาชญากรรม ข้อมูลสุขภาพ ความพิการ ข้อมูลสหภาพแรงงาน ข้อมูลพันธุกรรม ข้อมูลชีวภาพ หรือข้อมูลอื่นใดซึ่งกระทบต่อเจ้าของข้อมูลส่วนบุคคลในทำนองเดียวกันตามที่คณะกรรมการคุ้มครองข้อมูลส่วนบุคคลประกาศกำหนด

Personal data under Section 26 of the Personal Data Protection Act B.E. 2562 (2019), namely data on racial or ethnic origin, political opinions, cult, religious or philosophical beliefs, sexual behaviour, criminal records, health data, disability, trade union information, genetic data, biometric data, or any other data which similarly affects the data subject as prescribed by the Personal Data Protection Committee.

1.3 การประมวลผลข้อมูลส่วนบุคคลProcessing of Personal Data

การดำเนินการใด ๆ กับข้อมูลส่วนบุคคล เช่น เก็บรวบรวม บันทึก สำเนา จัดระเบียบ เก็บรักษา ปรับปรุง เปลี่ยนแปลง ใช้ กู้คืน เปิดเผย ส่งต่อ เผยแพร่ โอน รวม ลบ ทำลาย เป็นต้น

Any operation performed on personal data, such as collection, recording, copying, organisation, storage, updating, alteration, use, retrieval, disclosure, transmission, dissemination, transfer, combination, erasure or destruction.

1.4 เจ้าของข้อมูลส่วนบุคคลData Subject

บุคคลธรรมดาซึ่งเป็นเจ้าของข้อมูลส่วนบุคคลที่ ส.อ.ท. เก็บรวบรวม ใช้ หรือเปิดเผย

A natural person who is the owner of the personal data collected, used or disclosed by the FTI.

1.5 ผู้ควบคุมข้อมูลส่วนบุคคลData Controller

บุคคลหรือนิติบุคคลซึ่งมีอำนาจหน้าที่ตัดสินใจเกี่ยวกับการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคล ซึ่งในที่นี้คือ ส.อ.ท.

A person or juristic person having the power and duty to make decisions regarding the collection, use or disclosure of personal data, which in this case is the FTI.

1.6 ผู้ประมวลผลข้อมูลส่วนบุคคลData Processor

บุคคลหรือนิติบุคคลซึ่งดำเนินการเกี่ยวกับการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลตามคำสั่งหรือในนามของผู้ควบคุมข้อมูลส่วนบุคคล ทั้งนี้ บุคคลหรือนิติบุคคลซึ่งดำเนินการดังกล่าวไม่เป็นผู้ควบคุมข้อมูลส่วนบุคคล

A person or juristic person who carries out the collection, use or disclosure of personal data under the instructions of, or on behalf of, the data controller, provided that such person is not itself the data controller.

2. วัตถุประสงค์การเก็บรวบรวมข้อมูลส่วนบุคคล

2. Purposes of Collecting Personal Data

2.1 เพื่อปฏิบัติตามสัญญาPerformance of a Contract

เพื่อใช้ในการดำเนินการตามคำขอของท่านก่อนเข้าทำสัญญาหรือเพื่อปฏิบัติตามสัญญาซึ่งท่านเป็นคู่สัญญากับ ส.อ.ท. เช่น การสมัครเป็นสมาชิกของ ส.อ.ท. กลุ่มอุตสาหกรรม สภาอุตสาหกรรมจังหวัด สถาบันรหัสสากล หรือปฏิบัติตามสัญญาใด ๆ ซึ่งท่านเป็นคู่สัญญา เช่น การฝึกอบรม การสัมมนา การจับคู่ธุรกิจ และการออกใบรับรองต่าง ๆ

To take steps at your request prior to entering into a contract, or to perform a contract to which you are a party with the FTI, such as applying for membership of the FTI, an industry club, a provincial industry chapter or the GS1 Thailand institute, or to perform any contract to which you are a party, such as training, seminars, business matching and the issuance of certificates.

2.2 ประโยชน์โดยชอบด้วยกฎหมายLegitimate Interests

เพื่อประโยชน์โดยชอบด้วยกฎหมายของ ส.อ.ท. หรือของบุคคลอื่น เช่น การจัดการความสัมพันธ์ของสมาชิก การบำรุงรักษาระบบเทคโนโลยีสารสนเทศ ความปลอดภัย การประชาสัมพันธ์ข้อมูล และการใช้สิทธิเรียกร้องทางกฎหมาย

For the legitimate interests of the FTI or of other persons, such as membership relationship management, maintenance of information technology systems, security, public communications and the exercise of legal claims.

เพื่อให้ ส.อ.ท. สามารถจัดการ พัฒนา และดำเนินการใด ๆ เพื่อให้สามารถให้บริการแก่ท่าน ในทุกช่องทาง การจัดการความสัมพันธ์ของสมาชิกและบุคคลภายนอก การบำรุงรักษาและการใช้ระบบเทคโนโลยีสารสนเทศTo enable the FTI to manage, develop and carry out any operations necessary to provide services to you through all channels, to manage relationships with members and third parties, and to maintain and use information technology systems.
เพื่อประโยชน์ทางด้านความปลอดภัย เช่น จัดให้มีมาตรการรักษาความปลอดภัย ซึ่งรวมถึงข้อมูลส่วนบุคคลของท่านด้วย เช่น การเข้าสถานที่ของ ส.อ.ท. การเข้าสู่ระบบ (Log in) เข้าเว็บไซต์หรือแอปพลิเคชันต่าง ๆ ของ ส.อ.ท.For security purposes, such as putting in place security measures which also cover your personal data, for example access to FTI premises and log-in to FTI websites or applications.
เพื่อประชาสัมพันธ์ข้อมูล เช่น การแจ้งข่าวสารและสิทธิประโยชน์ต่าง ๆ ของสมาชิก ผ่านทางอีเมล เอสเอ็มเอส แอปพลิเคชัน โซเชียลมีเดีย โทรศัพท์ ไดเร็กเมล รวมถึงเพื่อประโยชน์ในการศึกษา วิเคราะห์ วิจัย ข้อมูลต่าง ๆ ที่เกี่ยวข้องกับการค้า การลงทุน และการประกอบอุตสาหกรรมFor public communications, such as notifying members of news and benefits by email, SMS, applications, social media, telephone and direct mail, as well as for the purposes of study, analysis and research on matters relating to trade, investment and industrial operations.
เพื่อการใช้สิทธิเรียกร้องทางกฎหมายFor the exercise of legal claims.

2.3 เพื่อป้องกันและระงับอันตรายPrevention of Harm

เพื่อป้องกันและระงับอันตรายต่อชีวิต ร่างกาย หรือสุขภาพของท่านหรือบุคคลอื่น เช่น การติดต่อในกรณีฉุกเฉิน การควบคุมและป้องกันโรคติดต่อ

To prevent or suppress a danger to the life, body or health of you or another person, such as emergency contact and the control and prevention of communicable diseases.

2.4 เพื่อปฏิบัติตามกฎหมายCompliance with the Law

เพื่อให้สามารถปฏิบัติตามกฎหมาย เช่น การปฏิบัติตามบทบัญญัติของกฎหมาย กฎระเบียบ และคำสั่งของผู้ที่มีอำนาจตามกฎหมาย

To comply with the law, such as complying with statutory provisions, regulations and the orders of persons with legal authority.

2.5 เพื่อปฏิบัติหน้าที่ตามอำนาจรัฐPerformance of Delegated Public Authority

เพื่อปฏิบัติหน้าที่ในการใช้อำนาจรัฐที่ได้มอบให้ เช่น การออกใบรับรอง Made in Thailand ใบรับรองถิ่นกำเนิดสินค้า

To perform duties in the exercise of state authority delegated to the FTI, such as issuing Made in Thailand certificates and certificates of origin.

2.6 กรณีที่ท่านให้ความยินยอมWhere You Have Given Consent

ส.อ.ท. จะประมวลผลข้อมูลส่วนบุคคล เพื่อส่งข่าวสารการจัดงานสัมมนา การประชุม การฝึกอบรม และการให้บริการต่าง ๆ ของ ส.อ.ท. หรือของพันธมิตรของ ส.อ.ท. ผ่านทางอีเมล เอสเอ็มเอส แอปพลิเคชัน โซเชียลมีเดีย โทรศัพท์ และไดเร็กเมลของท่าน รวมถึงกิจกรรมอื่น ๆ นอกจากที่กล่าวมาข้างต้น โดยอาจเก็บข้อมูลส่วนบุคคลของท่านเพิ่มเติม ซึ่งจะแจ้งใ⁠ห้⁠ท่⁠า⁠น⁠ท⁠ร⁠า⁠บและขอความยินยอมจากท่านเป็นคราว ๆ ไป

The FTI will process personal data in order to send news about seminars, meetings, training and various services of the FTI or of its partners by email, SMS, applications, social media, telephone and direct mail, as well as for other activities beyond those mentioned above. Additional personal data may be collected, in which case the FTI will inform you and request your consent on a case-by-case basis.

3. ข้อมูลส่วนบุคคลที่เก็บรวบรวม

3. Personal Data Collected

ส.อ.ท. จะเก็บรวบรวมข้อมูลส่วนบุคคลของท่าน ดังนี้

The FTI collects the following categories of your personal data:

3.1 ข้อมูลเฉพาะตัวIdentification Data

คำนำหน้าชื่อ ชื่อ นามสกุล ชื่อกลาง ชื่อเล่น ลายมือชื่อ เลขที่บัตรประจำตัวประชาชน สัญชาติ เลขที่ใบขับขี่ เลขที่หนังสือเดินทาง ข้อมูลทะเบียนบ้าน

Title, first name, last name, middle name, nickname, signature, national ID number, nationality, driving licence number, passport number and house registration details.

3.2 ข้อมูลสำหรับการติดต่อContact Data

ที่อยู่ทางไปรษณีย์บ้าน เบอร์โทรศัพท์ อีเมล ชื่อผู้ใช้งานในสังคมออนไลน์ (Line ID)

Home postal address, telephone number, email address and social media usernames (such as Line ID).

3.3 ข้อมูลเกี่ยวกับการทำงานและการศึกษาEmployment and Education Data

ประเภทการจ้างงาน อาชีพ ยศ ตำแหน่ง หน้าที่ ความเชี่ยวชาญ สถานภาพใบอนุญาตทำงาน ข้อมูลบุคคลอ้างอิง หมายเลขประจำตัวผู้เสียภาษี ประวัติการดำรงตำแหน่ง ประวัติการทำงาน ข้อมูลเงินเดือน วันเริ่มงาน วันออกจากงาน ผลการประเมิน สวัสดิการและสิทธิประโยชน์ พัสดุในครอบครองของผู้ปฏิบัติงาน ผลงาน หมายเลขบัญชีธนาคาร สถาบันการศึกษา วุฒิการศึกษา ผลการศึกษา วันที่สำเร็จการศึกษา

Type of employment, occupation, rank, position, duties, areas of expertise, work permit status, referee details, taxpayer identification number, position history, employment history, salary information, start date, end date, appraisal results, welfare and benefits, assets held by the employee, work output, bank account number, educational institution, qualifications, academic results and graduation date.

3.4 ข้อมูลที่มีความอ่อนไหวSensitive Data

ข้อมูลชีวภาพ (ข้อมูลสแกนใบหน้า ลายนิ้วมือ ม่านตา) เพื่อใช้ในการระบุตัวตน ข้อมูลศาสนาซึ่งปรากฏอยู่ในบัตรประชาชนของท่าน เพื่อใช้ในการยืนยันตัวตนของท่านหรือดำเนินการทางภาษี ข้อมูลการแพ้อาหาร เพื่อใช้ในการดำเนินกิจกรรมต่าง ๆ

Biometric data (facial scan, fingerprint and iris data) for identification purposes; religious information appearing on your national ID card, used to verify your identity or for tax purposes; and food allergy information, used in the running of various activities.

4. การขอความยินยอมและผ⁠ล⁠ก⁠ร⁠ะ⁠ท⁠บที่เป็นไปได้จากการถอนความยินยอม

4. Requesting Consent and the Possible Effects of Withdrawing Consent

4.1 สิทธิในการถอนความยินยอมRight to Withdraw Consent

ในกรณีที่ ส.อ.ท. เก็บรวบรวมและประมวลผลข้อมูลส่วนบุคคลโดยอาศัยความยินยอมของท่าน ท่านมีสิทธิที่จะถอนความยินยอมของท่านที่ให้ไว้กับ ส.อ.ท. ได้ตลอดเวลา ซึ่งการถอนความยินยอมนี้จะไม่ส่งผ⁠ล⁠ก⁠ร⁠ะ⁠ท⁠บต่อการเก็บรวบรวม ใช้ เปิดเผย หรือประมวลผลข้อมูลส่วนบุคคลที่ท่านได้ให้ความยินยอมไปแล้ว

Where the FTI collects and processes personal data on the basis of your consent, you have the right to withdraw the consent given to the FTI at any time. Such withdrawal does not affect the collection, use, disclosure or processing of personal data to which you have already consented.

4.2 ผ⁠ล⁠ก⁠ร⁠ะ⁠ท⁠บจากการถอนความยินยอมEffects of Withdrawing Consent

หากท่านถอนความยินยอมที่ได้ให้ไว้กับ ส.อ.ท. หรือปฏิเสธไม่ให้ข้อมูลบางอย่าง อาจส่งผลให้ ส.อ.ท. ไม่สามารถดำเนินการเพื่อบรรลุวัตถุประสงค์บางส่วนหรือทั้งหมดตามที่ระบุไว้ในนโยบายความเป็นส่วนตัวนี้ได้

If you withdraw the consent given to the FTI or decline to provide certain data, the FTI may be unable to achieve some or all of the purposes set out in this Privacy Policy.

4.3 กรณีผู้ไม่บรรลุนิติภาวะMinors

หากท่านมีอายุไม่ครบ 20 ปี⁠บ⁠ริ⁠บู⁠ร⁠ณ์ ก่อนการให้ความยินยอมโปรดแจ้งรายละเอียดผู้ใช้อำนาจปกครองให้ ส.อ.ท. ทราบเพื่อให้ ส.อ.ท. สามารถดำเนินการขอความยินยอมจากผู้ใช้อำนาจปกครองด้วย

If you are under 20 years of age, please provide the FTI with the details of the holder of parental responsibility before giving consent, so that the FTI can also obtain consent from that person.

5. แหล่งที่มาของข้อมูลส่วนบุคคล

5. Sources of Personal Data

ส.อ.ท. เก็บรวบรวมหรือได้มาซึ่งข้อมูลส่วนบุคคลประเภทต่าง ๆ จากแหล่งข้อมูลดังต่อไปนี้

The FTI collects or obtains the various categories of personal data from the following sources:

1) เก็บรวบรวมจากเจ้าของข้อมูลโดยตรงCollected Directly from the Data Subject

ในช่องทางให้บริการต่าง ๆ เช่น ขั้นตอนการสมัคร ลงทะเบียน สมัครงาน ลงนามในสัญญา เอกสาร ทำแบบสำรวจหรือใช้บริการ หรือช่องทางให้บริการอื่นที่ควบคุมดูแลโดย ส.อ.ท. หรือเมื่อเจ้าของข้อมูลส่วนบุคคลติดต่อสื่อสารกับ ส.อ.ท. ณ ที่ทำการหรือผ่านช่องทางติดต่ออื่นที่ควบคุมดูแลโดย ส.อ.ท.

Through various service channels, such as application, registration, job application, signing of contracts and documents, completing surveys or using services, or other service channels controlled by the FTI, or when the data subject communicates with the FTI at its offices or through other contact channels controlled by the FTI.

2) เก็บรวบรวมจากการใช้งานเว็บไซต์Collected from Website Usage

ข้อมูลที่ ส.อ.ท. เก็บรวบรวมจากการที่เจ้าของข้อมูลส่วนบุคคลเข้าใช้งานเว็บไซต์ หรือบริการอื่น ๆ ตามสัญญาหรือตามพันธกิจ เช่น การติดตามพฤติกรรมการใช้งานเว็บไซต์ หรือบริการของ ส.อ.ท. ด้วยการใช้คุกกี้ (Cookies) หรือจากซอฟต์แวร์บนอุปกรณ์ของเจ้าของข้อมูลส่วนบุคคล

Data collected by the FTI when the data subject uses its website or other services under a contract or its mandate, such as tracking website or service usage behaviour through cookies or software on the data subject's device.

3) เก็บรวบรวมจากแหล่งอื่นCollected from Other Sources

ข้อมูลส่วนบุคคลที่ ส.อ.ท. เก็บรวบรวมจากแหล่งอื่นนอกจากเจ้าของข้อมูลส่วนบุคคล เช่น การรับสมัครสมาชิก ส.อ.ท.

Personal data collected by the FTI from sources other than the data subject, such as in the course of FTI membership applications.

นอกจากนี้ ยังหมายความรวมถึงกรณีที่ท่านเป็นผู้ให้ข้อมูลส่วนบุคคลของบุคคลภายนอกแก่ ส.อ.ท. ดังนั้น ท่านมีหน้าที่รับผิดชอบในการแจ้งรายละเอียดตามนโยบายนี้หรือประกาศของการบริการ ตามแต่กรณี ให้บุคคลดังกล่าวทราบ ตลอดจนขอความยินยอมจากบุคคลนั้นหากเป็นกรณีที่ต้องได้รับความยินยอมในการเปิดเผยข้อมูลแก่ ส.อ.ท.

This also covers cases where you provide the FTI with the personal data of third parties. In such cases, you are responsible for informing those persons of the details set out in this Policy or in the relevant service notice, as applicable, and for obtaining their consent where consent is required to disclose their data to the FTI.

ทั้งนี้ ในกรณีที่เจ้าของข้อมูลส่วนบุคคลปฏิเสธไม่ให้ข้อมูลที่มีความจำเป็นในการให้บริการของ ส.อ.ท. อาจเป็นผลให้ ส.อ.ท. ไม่สามารถให้บริการนั้นแก่เจ้าของข้อมูลส่วนบุคคลดังกล่าวได้ทั้งหมดหรือบางส่วน

Where a data subject declines to provide data necessary for the FTI to deliver a service, the FTI may be unable to provide that service to the data subject, either in whole or in part.

The FTI collects and uses cookies and other similar technologies on websites under its supervision, such as www.fti.or.th, or on your device depending on the services you use. 7. การเปิดเผยข้อมูลส่วนบุคคลแก่บุคคลอื่น

7. Disclosure of Personal Data to Others

ส.อ.ท. อาจเปิดเผยข้อมูลส่วนบุคคลของท่านให้บุคคลอื่นทราบ ดังนี้

The FTI may disclose your personal data to the following persons:

ผู้ให้บริการนำเข้าข้อมูล (Data entry service providers)Data entry service providers.
ที่ปรึกษาผู้เชี่ยวชาญ ผู้ให้คำปรึกษา และ/หรือ ผู้ตรวจสอบบัญชีภายนอกExpert advisers, consultants and/or external auditors.

Third parties are entitled to use your personal data only to carry out the activities specified in their contract with the FTI. The contracts the FTI enters into with such third parties require them to comply with the law and with any policies prescribed by the FTI, and to apply appropriate measures to ensure that your personal data is protected and secure.

8. Cross-Border Transfer of Personal Data

8.1

ส.อ.ท. อาจส่งหรือโอนข้อมูลส่วนบุคคลของท่านให้บุคคลอื่นในต่างประเทศในกรณีที่จำเป็นเพื่อการปฏิบัติตามสัญญาซึ่งท่านเป็นคู่สัญญา หรือเป็นการกระทำตามสัญญาระหว่าง ส.อ.ท. กับบุคคลหรือนิติบุคคลอื่นเพื่อประโยชน์ของท่านหรือเพื่อใช้ในการดำเนินการตามคำขอของท่านก่อนเข้าทำสัญญา หรือเพื่อป้องกันหรือระงับอันตรายต่อชีวิต ร่างกาย หรือสุขภาพของท่านหรือบุคคลอื่น เพื่อปฏิบัติตามกฎหมาย หรือเป็นการจำเป็นเพื่อดำเนินภารกิจเพื่อประโยชน์สาธารณะที่สำคัญ

The FTI may send or transfer your personal data to other persons abroad where necessary to perform a contract to which you are a party; to act under a contract between the FTI and another person or juristic person for your benefit; to take steps at your request prior to entering into a contract; to prevent or suppress a danger to the life, body or health of you or another person; to comply with the law; or where necessary to carry out a mission in the important public interest.

8.2

ส.อ.ท. อาจเก็บข้อมูลของท่านบนคอมพิวเตอร์เซิร์ฟเวอร์หรือคลาวด์ที่ให้บริการโดยบุคคลอื่น และอาจใช้โปรแกรมหรือแอปพลิเคชันของบุคคลอื่นในรูปแบบของการให้บริการซอฟท์แวร์สำเร็จรูปและรูปแบบของการให้บริการแพลตฟอร์มสำเร็จรูปในการประมวลผลข้อมูลส่วนบุคคลของท่าน แต่ ส.อ.ท. จะไม่อนุญาตให้บุคคลที่ไม่เกี่ยวข้องสามารถเข้าถึงข้อมูลส่วนบุคคลได้ และจะกำหนดให้บุคคลอื่นเหล่านั้นต้องมีมาตรการคุ้มครองความมั่นคงปลอดภัยที่เหมาะสม

The FTI may store your data on computer servers or cloud services operated by third parties, and may use third-party programs or applications in the form of software-as-a-service and platform-as-a-service to process your personal data. However, the FTI will not permit unrelated persons to access personal data, and will require such third parties to have appropriate security safeguards in place.

ในกรณีที่มีการส่งข้อมูลส่วนบุคคลของท่านไปยังต่างประเทศ ส.อ.ท. จะปฏิบัติตามกฎหมายคุ้มครองข้อมูลส่วนบุคคลและใช้มาตรการที่เหมาะสมเพื่อทำให้มั่นใจได้ว่าข้อมูลส่วนบุคคลของท่านจะได้รับการคุ้มครองและท่านสามารถใช้สิทธิที่เกี่ยวข้องกับข้อมูลส่วนบุคคลของท่านได้ตามกฎหมาย รวมถึง ส.อ.ท. จะกำหนดให้ผู้ที่ได้รับข้อมูลมีมาตรการปกป้องข้อมูลของท่านอย่างเหมาะสมและประมวลผลข้อมูลส่วนบุคคลดังกล่าวเท่าที่จำเป็นเท่านั้น และดำเนินการเพื่อป้องกันไม่ให้บุคคลอื่นใช้หรือเปิดเผยข้อมูลส่วนบุคคลโดยปราศจากอำนาจโ⁠ด⁠ย⁠มิ⁠ช⁠อ⁠บ

Where your personal data is transferred abroad, the FTI will comply with the personal data protection law and apply appropriate measures to ensure that your personal data is protected and that you can exercise your related legal rights. The FTI will also require recipients of the data to have appropriate protective measures in place, to process such personal data only to the extent necessary, and to take steps to prevent others from using or disclosing personal data without proper authority.

9. การเก็บรักษาและระยะเวลาในการเก็บรักษาข้อมูลส่วนบุคคล

9. Storage and Retention Period of Personal Data

9.1

ส.อ.ท. จะเก็บข้อมูลส่วนบุคคลของท่านในระยะเวลาที่จำเป็นเพื่อให้บรรลุวัตถุประสงค์ตามประเภทข้อมูลส่วนบุคคลแต่ละประเภท เว้นแต่กฎหมายจะอนุญาตให้มีระยะเวลาการเก็บรักษาที่นานขึ้นในกรณีที่ไม่สามารถระบุระยะเวลาการเก็บรักษาข้อมูลส่วนบุคคลได้ชัดเจน ส.อ.ท. จะเก็บรักษาข้อมูลไว้ตามระยะเวลาที่อาจคาดหมายได้ตามมาตรฐานของการเก็บรวบรวม (เช่น อายุความตามกฎหมายทั่วไปสูงสุด 10 ปี)

The FTI retains your personal data for as long as necessary to fulfil the purposes applicable to each category of personal data, unless the law permits a longer retention period. Where the retention period cannot be clearly specified, the FTI will retain the data for a period that may reasonably be expected according to collection standards (for example, the general statutory prescription period of up to 10 years).

9.2

ส.อ.ท. จัดให้มีระบบการตรวจสอบเพื่อดำเนินการลบหรือทำลายข้อมูลส่วนบุคคลเมื่อพ้นกำหนดระยะเวลาการเก็บรักษาหรือที่ไม่เกี่ยวข้องหรือเกินความจำเป็นตามวัตถุประสงค์ในการเก็บรวบรวมข้อมูลส่วนบุคคลนั้น

The FTI maintains an audit system to erase or destroy personal data once the retention period has expired, or where the data is irrelevant to or beyond what is necessary for the purposes for which it was collected.

9.3

กรณีที่ ส.อ.ท. ใช้ข้อมูลส่วนบุคคลของท่านโดยขอความยินยอมจากท่าน ส.อ.ท. จะประมวลผลข้อมูลส่วนบุคคลดังกล่าวจนกว่าท่านจะแจ้งขอยกเลิกความยินยอมและ ส.อ.ท. ดำเนินการตามคำขอของท่านเสร็จสิ้นแล้ว อย่างไรก็ดี ส.อ.ท. จะยังเก็บข้อมูลส่วนบุคคลของท่านเท่าที่จำเป็นสำหรับบันทึกเป็นประวัติว่าท่านเคยยกเลิกความยินยอม เพื่อให้ ส.อ.ท. สามารถตอบสนองต่อคำขอของท่านในอนาคตได้

Where the FTI uses your personal data on the basis of your consent, it will process that data until you notify it of the withdrawal of consent and the FTI has completed its handling of your request. However, the FTI will retain such personal data as is necessary to record the fact that you withdrew consent, so that it can respond to your requests in the future.

10.1

ความปลอดภัยของข้อมูลส่วนบุคคลของท่านเป็นสิ่งสำคัญสำหรับ ส.อ.ท. และ ส.อ.ท. ได้นำมาตรฐานความปลอดภัยทางเทคนิคและการบริหารที่เหมาะสมมาใช้เพื่อปกป้องข้อมูลส่วนบุคคลจากการสูญหาย การเข้าถึงการใช้หรือการเปิดเผยโดยไม่ได้รับอนุญาต การใช้งานในทางที่ผิด การดัดแปลงเปลี่ยนแปลง และการทำลายโดยใช้เทคโนโลยีและขั้นตอนการรักษาความปลอดภัย เช่น การเข้ารหัสและการจำกัดการเข้าถึง เพื่อให้มั่นใจว่าบุคคลที่ได้รับอนุญาตเท่านั้นที่เข้าถึงข้อมูลส่วนบุคคลของท่านและบุคคลเหล่านี้ได้รับการฝึกอบรมเกี่ยวกับความสำคัญของการปกป้องข้อมูลส่วนบุคคล

The security of your personal data is important to the FTI. The FTI applies appropriate technical and administrative security standards to protect personal data from loss, unauthorised access, use or disclosure, misuse, alteration and destruction, using security technologies and procedures such as encryption and access restriction. This ensures that only authorised persons can access your personal data, and that such persons are trained on the importance of protecting personal data.

10.2

ส.อ.ท. จัดให้มีมาตรการรักษาความปลอดภัยที่เหมาะสม เพื่อป้องกันการสูญหาย เข้าถึง ใช้ เปลี่ยนแปลง แก้ไข เปิดเผยข้อมูลส่วนบุคคลจากผู้ที่ไม่มีสิทธิหรือหน้าที่ที่เกี่ยวข้องกับข้อมูลส่วนบุคคลนั้น และจะจัดให้มีการทบทวนมาตรการดังกล่าวเมื่อมีความจำเป็นหรือเมื่อเทคโนโลยีเปลี่ยนแปลงไปเพื่อให้มีประสิทธิภาพในการรักษาความปลอดภัยที่เหมาะสม

The FTI puts in place appropriate security measures to prevent the loss of, or unauthorised access to, use, alteration, correction or disclosure of personal data by persons without the right or duty to handle that data, and will review those measures whenever necessary or when technology changes, so as to maintain appropriate and effective security.

ท่านสามารถขอเข้าถึง ขอรับสำเนาข้อมูลส่วนบุคคลของท่าน ตามหลักเกณฑ์และวิธีการที่ ส.อ.ท. กำหนด ณ ส⁠ภ⁠า⁠อุ⁠ต⁠ส⁠า⁠ห⁠ก⁠ร⁠ร⁠ม⁠แ⁠ห่⁠ง⁠ป⁠ร⁠ะ⁠เ⁠ท⁠ศ⁠ไ⁠ท⁠ย หรือขอให้เปิดเผยการได้มาซึ่งข้อมูลส่วนบุคคล ทั้งนี้ ส.อ.ท. อาจปฏิเสธคำขอของท่านได้ตามที่กฎหมายกำหนดหรือตามคำสั่งศาลYou may request access to and a copy of your personal data in accordance with the criteria and procedures prescribed by the FTI at The Federation of Thai Industries, or request disclosure of how your personal data was obtained. The FTI may refuse your request as permitted by law or by court order.
ท่านมีสิทธิในการเพิกถอนความยินยอมในการประมวลผลข้อมูลที่ท่านได้ให้ความยินยอมกับ ส.อ.ท. ได้ ตลอดระยะเวลาที่ ส.อ.ท. จัดเก็บข้อมูลส่วนบุคคลของท่านYou have the right to withdraw consent to the processing of data for which you have given consent to the FTI, at any time while the FTI retains your personal data.

ร้องเรียนต่อคณะกรรมการคุ้มครองข้อมูลส่วนบุคคล ในกรณีที่เราหรือผู้ประมวลผลข้อมูลส่วนบุคคล รวมทั้งลูกจ้างหรือผู้รับจ้างของเราหรือผู้ประมวลผลข้อมูลส่วนบุคคลฝ่าฝืนหรือไม่ปฏิบัติตามกฎหมายคุ้มครองข้อมูลส่วนบุคคลTo lodge a complaint with the Personal Data Protection Committee where we or our data processor, including our or the processor's employees or contractors, violate or fail to comply with the personal data protection law.
ท่านสามารถขอลบหรือทำลายข้อมูลส่วนบุคคลของท่าน เว้นแต่เป็นกรณีที่ ส.อ.ท. ต้องปฏิบัติตามกฎหมายที่เกี่ยวข้องในการเก็บรักษาข้อมูลดังกล่าว ทั้งนี้ ส.อ.ท. จะพิจารณาและแจ้งผลการพิจารณาตามคำร้องขอใช้สิทธิของท่านต่อไป และสิทธิตามที่กล่าวมาข้างต้น เป็นไปตามที่กฎหมายคุ้มครองข้อมูลส่วนบุคคลกำหนดYou may request the erasure or destruction of your personal data, except where the FTI is required by applicable law to retain such data. The FTI will consider and notify you of the outcome of your request. The rights described above are as prescribed by the personal data protection law.

ส.อ.ท. จะทำการพิจารณาทบทวนนโยบายความเป็นส่วนตัวเป็นประจำเพื่อให้สอดคล้องกับแนวปฏิบัติและกฎหมาย ข้อบังคับที่เกี่ยวข้อง ทั้งนี้ หากมีการเปลี่ยนแปลงนโยบายความเป็นส่วนตัว ส.อ.ท. จะแจ้งใ⁠ห้⁠ท่⁠า⁠น⁠ท⁠ร⁠า⁠บด้วยการปรับข้อมูลให้เป็นปัจจุบันลงในเว็บไซต์ของ ส.อ.ท. โดยเร็วที่สุด

The FTI reviews this Privacy Policy regularly to keep it aligned with relevant practices, laws and regulations. If this Privacy Policy changes, the FTI will inform you by updating the information on its website as soon as possible.
