ทวีความเข้มงวดเพื่อลดการปล่อยก๊าซเรือนกระจก

พิธีสารเกียวโต นับว่าเป็นข้อตกลงในระยะแรก ๆ ที่ประชาคมโลกให้ความสนใจต่อปัญหาการเปลี่ยนแปลงสภาพภูมิอากาศอย่างจริงจัง กลไกการพัฒนาที่สะอาด (Clean Development Mechanism: CDM) ก่อให้เกิดแนวคิดของคาร์บอนเครดิตและการซื้อขายคาร์บอนเครดิต รวมถึงการให้สัตยาบันในการร่วมกันลดการปล่อยก๊าซเรือนกระจกของกลุ่มสมาชิกที่เข้าข่ายการปล่อยก๊าซเรือนกระจกในปริมาณสูง

ความพยายามของประชาคมโลกต่อการดำเนินกิจกรรมเพื่อลดการปล่อยก๊าซเรือนกระจกจะถูกขับเคลื่อนในแต่ละภูมิภาคของโลก และทวีความเข้มข้นมากขึ้นเรื่อย ๆ โดยเฉพาะประเทศในกลุ่มสหภาพยุโรป หรือ EU (European Union) ที่ดูกำหนดทิศทางและการดำเนินกิจกรรมเพื่อลดปริมาณการปล่อยก๊าซเรือนกระจกอย่างเข้มงวดและจริงจัง

การออกมาตรการเกี่ยวกับการเปลี่ยนแปลงสภาพภูมิอากาศของ EU ไม่ใช่ครั้งแรกที่ EU ออกข้อกำหนดเพื่อบังคับใช้เพียงประเทศสมาชิก แต่ประเทศนอกกลุ่ม EU ที่เป็นประเทศคู่ค้า ล้วนถูกมาตรการนี้บังคับใช้ทางอ้อม เช่นเดียวกับระเบียบอื่น ๆ ที่ EU บังคับใช้มาก่อนหน้า ยกตัวอย่างเช่น ระเบียบ REACH ซึ่งเป็นระเบียบการจัดการสารเคมีที่จะนำเข้าสู่ EU ไม่ว่าจะในรูปของสารเจือปนในสินค้า หรือการนำเข้าสารเคมีโดยตรง ที่ผู้ประกอบการไทยต้องปรับตัวเพื่อให้สอดรับกับข้อกำหนดดังกล่าวในช่วงทศวรรษที่ผ่านมา

EU Green Deal คือ นโยบายของสหภาพยุโรป ในการเปลี่ยนผ่านกิจกรรมเศรษฐกิจสีเขียว ที่เรียกว่า มาตรการ Fit for 55 โดยมีจุดมุ่งหมายเพื่อลดปริมาณการปล่อยก๊าซเรือนกระจกลง 55 % ภายในปี 2030 (พ.ศ. 2573) โดยเทียบกับปี 1990 (พ.ศ. 2533) และมีเป้าหมายสู่การเป็นกลางทางคาร์บอน (Carbon Neutral) ในปี 2050 (พ.ศ. 2593) ซึ่งครอบคลุมมาตรการ ดังนี้

สิทธิการซื้อขายและการปล่อยก๊าซเรือนกระจกการคมนาคมสีเขียวทั้งทางบก ทางทะเล และทางอากาศอัตราภาษีธุรกิจที่เป็นมิตรกับสิ่งแวดล้อมการใช้พลังงานทดแทนตั้งเป้าหมายการดูดซับก๊าซเรือนกระจกมาตรการปรับคาร์บอนข้ามพรมแดน (Carbon Border Adjustment Mechanism: CBAM)

ส่งออกไทยต้องรู้ก่อน EU บังคับใช้จริง

หนึ่งในมาตรการสำคัญที่เรียกได้ว่ามีผลกระทบต่อผู้ประกอบการไทยที่เป็นคู่ค้าของประเทศในกลุ่ม EU คือ มาตรการลดปริมาณการปล่อยก๊าซเรือนกระจก หรืออาจกล่าวได้ว่าเป็นมาตรการภาษีคาร์บอน (Carbon Tax) ที่เป็นกลไกการปรับคาร์บอนข้ามพรมแดน หรือ CBAM ซึ่งเกิดจากการที่ EU ใช้มาตรการ EU ETS (Emission Trading Scheme) เก็บภาษีสิ่งแวดล้อมจากกิจกรรมที่ปล่อยก๊าซเรือนกระจกปริมาณมากเกินกว่าปริมาณที่กำหนดไว้ ซึ่งทำให้เกิดปัญหาการรั่วไหลของคาร์บอน (Carbon Leakage) กล่าวคือ ผู้ประกอบการใน EU ซึ่งมีต้นทุนดำเนินงานลดปริมาณการปล่อยก๊าซคาร์บอนไดออกไซด์สูงกว่าประเทศนอกเขต EU ซึ่งประเทศเหล่านั้นอาจไม่ได้มีมาตรการในการลดปริมาณการปล่อยก๊าซคาร์บอนที่เข้มงวดเท่าใน EU มีการย้ายฐานการผลิตไปยังในประเทศที่มีมาตรการด้านการปล่อยก๊าซคาร์บอนเข้มงวดน้อยกว่า ทำให้ภาระต้นทุนสินค้าในการผลิตต่ำกว่า หลังจากนั้นจึงส่งสินค้าที่ผลิตได้กลับเข้ามาขายใน EU ส่งผลให้เกิดความได้เปรียบด้านต้นทุน ซึ่งไม่ได้ทำให้ EU แก้ปัญหาการปล่อยก๊าซคาร์บอนได้อย่างเต็มที่ และแน่นอนว่าผู้บริโภคย่อมเลือกซื้อสินค้าราคาถูกเพราะมีต้นทุนต่ำกว่า เป็นการสร้างความไม่เป็นธรรมให้แก่ผู้ประกอบการใน EU ที่ดำเนินมาตรการลดปริมาณการปล่อยก๊าซคาร์บอนอย่างจริงจังโดยที่มีต้นทุนการดำเนินงานที่สูงกว่า

มาตรการ CBAM จึงกำหนดให้เก็บค่าใบรับรองคาร์บอน (Carbon Certificate) ในสินค้าที่นำเข้า EU โดยประเมินจากส่วนต่างของปริมาณการปล่อยก๊าซคาร์บอนของสินค้ากับปริมาณการปล่อยก๊าซคาร์บอนที่อนุญาตให้มีการปล่อยได้ในสินค้าแต่ละประเภท เพื่อเป็นค่าปรับในสินค้านำเข้าที่มีมาตรการลดการปล่อยก๊าซคาร์บอนต่ำกว่า ดังนั้น สินค้าจากผู้ประกอบการภายใน EU ที่ทำให้เกิด Carbon Leakage หรือสินค้าจากผู้ผลิตภายนอก EU ที่ส่งสินค้าไปจำหน่ายใน EU จะมีต้นทุนทางสิ่งแวดล้อมเทียบเท่ากับสินค้าที่ผลิตใน EU ทำให้ลดความได้เปรียบทางการค้าของสินค้าประเภทเดียวกัน เพราะ EU เน้นหลักความเท่าเทียมของสินค้าประเภทเดียวกัน ที่ไม่ว่าจะมาจากภายในหรือภายนอก EU จะต้องได้รับการปฏิบัติบนมาตรฐานเดียวกัน ไม่ว่าจะเป็นด้านกฎระเบียบ หรือข้อกำหนดอื่นใด

จากที่กล่าวมา ทำให้ผู้ประกอบการในประเทศคู่ค้ากับกลุ่ม EU ได้รับผลกระทบจากมาตรการดังกล่าวเช่นกัน เบื้องต้น CBAM มีผลกับสินค้า 5 กลุ่ม ได้แก่ เหล็กและเหล็กกล้า ปุ๋ย ซีเมนต์ ไฟฟ้า อะลูมิเนียม ไฮโดรเจน และมีแนวโน้มจะขยายไปสู่สินค้ากลุ่มอื่น ๆ อีก ได้แก่ เคมีภัณฑ์อินทรีย์ พลาสติก แก้ว เซรามิก ยิปซัม กระดาษ และโพลิเมอร์ นอกจากนี้ยังมีแนวโน้มจะขยายขอบเขตให้ครอบคลุมการปล่อยก๊าซคาร์บอนทางอ้อม (Indirect Emissions) ซึ่งก็คือการใช้ไฟฟ้าในกระบวนการผลิตของสินค้าทั้ง 9 กลุ่ม

CBAM เริ่มมีผลบังคับใช้วันที่ 1 ตุลาคม 2566 โดยผู้ผลิตที่จะส่งสินค้าเข้าไปขายใน EU จะต้องแสดงตัวเลขปริมาณการปล่อยก๊าซเรือนกระจกหรือค่าการปล่อยก๊าซคาร์บอน ซึ่งจะยังไม่มีการจ่ายค่าปรับ จนกว่าจะถึงวันที่ 1 มกราคม 2569 ผลกระทบของ CBAM เป็นลักษณะคล้ายภาษีดังที่กล่าวมาแล้ว ซึ่งเป็นลักษณะของภาษีคาร์บอน (Carbon TAX) ที่ทำให้ต้นทุนสินค้าของที่นำเข้าสู่ EU มีราคาสูงขึ้นจาก CBAM Certificate ทำให้สินค้าใน EU อาจมีราคาต่ำกว่าสินค้านำเข้า

สำหรับปริมาณการปล่อยก๊าซคาร์บอนที่ต้องรายงาน ในปัจจุบันทาง EU ยังไม่ได้กำหนดมาตรฐานชัดเจนอย่างเป็นทางการว่ามีหลักการประเมินอย่างไร แต่หากเทียบกับการดำเนินงานในประเทศไทยแล้ว ผู้ประกอบการสามารถเตรียมตัวโดยเทียบเคียงกับหลักการประเมินคาร์บอนฟุตพรินท์ (Carbon Footprint) ของผลิตภัณฑ์ เนื่องจากเป็นการพิจารณาปริมาณการปล่อยก๊าซเรือนกระจกที่ผลิตภัณฑ์แต่ละชนิดปล่อยออกมาตลอดวัฏจักรชีวิต ส่วนทาง EU จะมีข้อกำหนดให้มีการประเมินการปล่อยก๊าซเรือนกระจกจากกิจกรรมอื่น ๆ เพิ่มเติมหรือไม่ คงต้องติดตามประกาศของทาง EU ต่อไป

Since the Industrial Revolution, advancements in production technology and industrial operations have significantly transformed economies, societies, and cultures, such as economic expansion and population growth. Coupled with the invention of new technologies and widespread technology transfer, there has been a transition from relying on human labor to the use of machinery. This has resulted in economies that were once primarily agricultural becoming increasingly industrial, along with the discovery of new products and inventions that have improved the living conditions of people worldwide, providing them with more goods and conveniences. However, while the global population has enjoyed living through the use of technology, products, and modern sciences for over 300 years, they have overlooked the future impacts that could arise, such as the search for resources to support industrial use, whether through mining or drilling for fossil energy sources beneath the Earth's surface, which serve as the world's primary energy source.

Increasing Stringency to Reduce Greenhouse Gas Emissions

The Kyoto Protocol is considered an early agreement that the global community took seriously regarding climate change issues. The Clean Development Mechanism (CDM) gave rise to the concept of carbon credits and carbon credit trading, as well as the commitment to jointly reduce greenhouse gas emissions among member countries that fall under high greenhouse gas emissions.

The global community's efforts to undertake activities to reduce greenhouse gas emissions will be driven in each region of the world, becoming increasingly intense, especially in the European Union (EU), which is seen to be setting strict and serious directions and activities to reduce greenhouse gas emissions.

EU measures concerning climate change are not the first time the EU has issued regulations to be enforced solely on member countries, but also on non-EU countries that are trading partners, which indirectly become subject to these measures, similar to other regulations previously enforced by the EU, such as the REACH regulation, which governs the management of chemicals imported into the EU, whether in the form of substances mixed into products or direct imports of chemicals. Thai operators have had to adapt to meet these requirements over the past decade.

The EU Green Deal is a policy of the European Union to transition economic activities towards green practices, referred to as the Fit for 55 measures, with the objective of reducing greenhouse gas emissions by 55% by 2030 (CE 2023) compared to 1990 (CE 1990) and aiming towards carbon neutrality (Carbon Neutral) by 2050 (CE 2053), which includes the following measures:

The rights to trade and release greenhouse gases in green transportation, both land, sea, and air; tax rates for environmentally friendly businesses; the use of renewable energy; targets for carbon dioxide absorption; and the Carbon Border Adjustment Mechanism (CBAM).

Thai Exports Must Know Before EU Implementation

One of the crucial measures that significantly impacts Thai operators engaging with EU countries is the measure to reduce greenhouse gas emissions, or it can be said that it is a carbon tax mechanism, known as the Carbon Border Adjustment Mechanism or CBAM, which arises from the EU implementing the EU ETS (Emission Trading Scheme) to impose environmental taxes on activities that emit greenhouse gases beyond the defined limit. This leads to the issue of carbon leakage, whereby EU operators, facing high operational costs to reduce carbon dioxide emissions, relocate production to countries outside the EU where such strict carbon emission reduction measures do not exist. This allows them to produce goods at lower costs, which are subsequently imported back to sell in the EU, resulting in a cost advantage and not allowing the EU to fully address the carbon emission problems. Naturally, consumers would opt for cheaper products due to their lower costs, thereby creating unfairness for EU operators who genuinely pursue stringent greenhouse gas emission reduction measures with higher operational costs.

The CBAM measure, therefore, stipulates the collection of carbon certificates on products imported into the EU, estimating based on the discrepancy between the carbon emissions of the product and the allowable emissions for each type of product, serving as a penalty for imported goods that have lower carbon emission reduction measures. Thus, products from EU operators that result in carbon leakage or products from producers outside the EU sending goods for sale in the EU will have environmental costs equivalent to those produced within the EU, reducing the trade advantage of similarly categorized goods. This is because the EU emphasizes the principle of equality for similar goods, whereby regardless of their origin, either from within or outside the EU, they must conform to the same standards, including regulations or other requirements.

Given this, operators in trading partner countries with the EU are also affected by this measure. Initially, CBAM applies to five product groups: steel and iron, fertilizers, cement, electricity, aluminum, and hydrogen, with a tendency to expand to other product groups including organic chemicals, plastics, glass, ceramics, gypsum, paper, and polymers. Moreover, there is a likelihood of extending the scope to cover indirect carbon emissions, which is the electricity used in the production processes of all nine product groups.

CBAM Begins Implementation on October 1, 2023 whereby producers wishing to sell products in the EU must disclose the greenhouse gas emission figures or carbon emission values, with no penalties imposed until January 1, 2026. The impact of CBAM is similar to a tax, which is described as a carbon tax that raises the cost of goods imported into the EU due to the CBAM Certificate, resulting in potentially lower prices for EU-produced goods compared to imported goods.

As for the volume of carbon emissions that must be reported, the EU has not yet established a clear official standard for how the assessment principles will be made. However, compared to operations in Thailand, producers can prepare by aligning with the principles of carbon footprint assessment, as it considers the greenhouse gas emissions that each type of product emits throughout its life cycle. Whether the EU will impose additional greenhouse gas emission assessments from other activities remains to be monitored through EU announcements.
