สภาอุตสาหกรรมแห่งประเทศไทย
ในช่วงทศวรรษที่ผ่านมา โลกประสบกับปัญหาและความเปลี่ยนแปลงมากมาย ไม่ว่าจะเป็นการปรับเปลี่ยนมาใช้เทคโนโลยีดิจิทัลแทนการใช้แรงงานคน ปัญหาความไม่แน่นอนทางเศรษฐกิจ ปัญหาโรคระบาดที่สร้างความชะงักงันให้กับเศรษฐกิจโลกและการดำรงชีวิตของประชาชน ต่อมาอีกปัญหาหนึ่งที่กำลังคืบคลานเข้ามา และต้องได้รับการแก้ไขโดยเร่งด่วนคือ ปัญหาการเปลี่ยนแปลงสภาพภูมิอากาศ ซึ่งเป็นปัญหาระดับโลก ที่ต้องประสานความร่วมมือกันแก้ไขปัญหากันอย่างจริงจัง อย่างไรก็ตาม การแก้ไขปัญหาดังกล่าว ไม่ใช่โดยประเทศใดประเทศหนึ่ง หรือหน่วยงานใดหน่วยงานหนึ่งในประเทศนั้น หากแต่ต้องประสานความร่วมมือกันเพื่อปะติดปะต่อให้เกิดผลของการแก้ปัญหาในภาพรวมของโลก

กลุ่มประเทศที่เริ่มกำหนดมาตรการแก้ปัญหาอย่างจริงจัง คงหนีไม่พ้นประเทศในกลุ่มสหภาพยุโรปที่สร้างข้อกำหนดและมาตรการต่าง ๆ มารองรับ เพื่อให้ผู้ประกอบการและประชาชนในกลุ่มประเทศเหล่านี้ถือปฏิบัติ เช่น มาตรการการเก็บภาษีคาร์บอน มาตรการบังคับให้ผู้ประกอบการอุตสาหกรรมดำเนินวิธีการลดปริมาณการปล่อยก๊าซเรือนกระจก ไม่เกินปริมาณการปล่อยก๊าซเรือนกระจกที่อนุญาตให้ปล่อยได้ในแต่ละอุตสาหกรรม ซึ่งหลากหลายมาตรการบ่งชี้ว่าเป็นมาตรการบังคับเฉพาะสมาชิก หากแต่เมื่อนำไปปฏิบัติแล้วพบว่า มีผลกระทบกับผู้มีส่วนเกี่ยวข้องนอกประเทศสมาชิกอยู่ไม่น้อย เช่น มาตรการปรับคาร์บอนข้ามพรมแดน หรือ CBAM (Carbon Border Adjustment Mechanism) ที่มีสาระสำคัญให้ผู้นำเข้าสินค้าจากนอกสหภาพยุโรป ต้องมีการจ่ายค่าชดเชยคาร์บอนส่วนเกินจากที่ได้รับอนุญาตให้ปล่อยได้ของแต่ละกลุ่มอุตสาหกรรม ซึ่งแท้จริงแล้ว มาตรการดังกล่าวก็ส่งผลกระทบต่อผู้ประกอบการส่งออกของไทยในกลุ่มสินค้าที่ CBAM เริ่มมีผลบังคับใช้นอกจากประเทศในกลุ่มสหภาพยุโรปแล้ว แม้แต่ประเทศในภูมิภาคอื่น ไม่ว่าจะเป็น สหรัฐอเมริกา จีน และสหราชอาณาจักร ต่างก็กำลังสร้างเงื่อนไข กฎ และระเบียบ ในลักษณะเดียวกัน

สำหรับประเทศไทยเอง การดำเนินกิจกรรมด้านการเปลี่ยนแปลงสภาพภูมิอากาศ เริ่มปรากฏให้เห็นมากขึ้นเรื่อย ๆ ตั้งแต่การสร้างกลไกการประเมินการปล่อยก๊าซเรือนกระจก และระบบการขอรับรอง การสร้างกลไกการชดเชยการปล่อยก๊าซเรือนกระจกภาคสมัครใจ การจัดตั้งกรมการเปลี่ยนแปลงสภาพภูมิอากาศ และล่าสุดการยกร่าง พ.ร.บ. การเปลี่ยนแปลงสภาพภูมิอากาศ นับเป็นการออกข้อกำหนดด้านการเปลี่ยนแปลงสภาพภูมิอากาศของไทยอย่างเป็นทางการเป็นครั้งแรก ซึ่ง ร่าง พ.ร.บ. ดังกล่าวผ่านขั้นตอนการรับฟังข้อคิดเห็นแล้ว และจะดำเนินการตามขั้นตอนของกฎหมายเพื่อประกาศใช้ต่อไปในเร็ว ๆ นี้

โดยสาระสำคัญของร่าง พ.ร.บ. ดังกล่าว กำหนดให้หน่วยงานของภาครัฐมีการจัดทำฐานข้อมูลก๊าซเรือนกระจกของประเทศ โดยครอบคลุมกิจกรรมการปล่อย การกักเก็บ การดูดกลับ และแนวทางการลดปริมาณการปล่อยก๊าซเรือนกระจก (มาตรา 26) ทั้งนี้ พ.ร.บ. ดังกล่าวยังให้อำนาจแก่หน่วยงานภาครัฐมีอำนาจเรียกขอข้อมูลจากผู้มีส่วนเกี่ยวข้องกับการครอบครองข้อมูลดังกล่าว (มาตรา 27) ซึ่งครอบคลุมผู้ประกอบการอุตสาหกรรมด้วยเช่นกัน แต่อย่างไรก็ตาม ข้อมูลที่หน่วยงานหรือองค์กรผู้มีส่วนเกี่ยวข้องกับการให้ข้อมูล ก็ยังได้รับการคุ้มครองเป็นความลับ ห้ามไม่ให้มีการเปิดเผยข้อมูลดังกล่าวอันอาจนำมาซึ่งความเสียหายต่อเจ้าของข้อมูลได้ (มาตรา 29 และ 30)

และหลังจากรับทราบข้อมูลแล้วหน่วยงานของภาครัฐต้องจัดทำแผนปฏิบัติการลดก๊าซเรือนกระจกของประเทศ โดยมีการกำหนดนโยบาย งบประมาณ และการตรวจติดตาม กำกับให้การดำเนินการลดการปล่อยก๊าซเรือนกระจกเป็นไปตามแผนหรือนโยบายที่กำหนดไว้ นอกจากนี้ ภาครัฐยังต้องให้การส่งเสริมการดำเนินกิจกรรมด้านการเปลี่ยนแปลงสภาพภูมิอากาศ ไม่ว่าจะเป็นด้านงบประมาณ องค์ความรู้ และเทคโนโลยี เพื่อให้สอดรับกับการนำส่งข้อมูลการปล่อยก๊าซเรือนกระจก รวมไปถึงการดำเนินกิจกรรมเพื่อลดการปล่อยก๊าซเรือนกระจกของประเทศ

ความสำคัญกับผู้ประกอบการไทย
ร่าง พ.ร.บ. ดังกล่าว ผนวกกับการดำเนินมาตรการด้านการเปลี่ยนแปลงสภาพภูมิอากาศของต่างประเทศ ที่ผู้ประกอบการต้องเข้าไปมีส่วนเกี่ยวข้อง ซึ่งมีความเป็นไปได้ว่า การกำหนดมาตรการและการดำเนินงานด้านการเปลี่ยนแปลงสภาพภูมิอากาศของประเทศไทย อาจได้รับอิทธิพลจากแนวคิดของต่างประเทศมาประยุกต์ใช้ เช่น มาตรการชดเชยคาร์บอน ซึ่งกำหนดให้ผู้ประกอบการที่ปล่อยคาร์บอนมากกว่าที่กำหนด ต้องรับผิดชอบโดยการปรับปรุงกระบวนการดำเนินธุรกิจเพื่อลดการปล่อยก๊าซเรือนกระจกให้ต่ำลง หรือหากปฏิบัติไม่ได้ ก็ต้องอาศัยกลไกของตลาดคาร์บอนหรือการซื้อคาร์บอนเครดิต มาตรการการเก็บภาษีคาร์บอนจากสินค้าที่มีการปล่อยก๊าซเรือนกระจกในอัตราสูง ซึ่งหลากหลายมาตรการแน่นอนว่าต้องส่งผลกระทบต่อภาคประชาชนจากต้นทุนการดำเนินงานที่สูงขึ้น

อย่างไรก็ตาม เมื่อพิจารณาตามมาตรการต่าง ๆ ที่กำลังจะเกิดขึ้น อาจเป็นสิ่งที่ผู้ประกอบการไทยต้องปฏิบัติอย่างหลีกเลี่ยงไม่ได้เพื่อรักษาตลาดไว้ หากไม่ดำเนินกลไกใด ๆ อย่างเหมาะสมแล้ว ผู้ประกอบการไทยอาจเสียเปรียบทางการค้าได้ รวมถึงอาจถูกมองว่าประเทศไทยไม่มีบทบาทและมาตรการเพื่อร่วมแก้ปัญหาโลกอย่างจริงจัง ดังนั้น ผู้ที่มีส่วนเกี่ยวข้องจากทุกภาคส่วน ควรร่วมมือกันหามาตรการรองรับ และปรับรูปแบบการดำเนินการให้ส่งผลกระทบต่อภาคประชาชนให้น้อยที่สุด

In the past decade, the world has faced numerous problems and changes, including the shift to digital technology instead of human labor, economic uncertainty, and pandemics that have caused stagnation in the global economy and people's livelihoods. Another issue that is gradually emerging and urgently needs to be addressed is climate change, which is a global problem that requires serious cooperation to resolve. However, addressing this issue cannot be achieved by just one country or one agency within that country, but must involve collaboration to construct a comprehensive solution for the global perspective.

The group of countries that has begun to establish serious measures to address these issues is undoubtedly the European Union, which has created various regulations and measures to support compliance for entrepreneurs and citizens in these countries, such as carbon taxation measures and regulations requiring industrial entrepreneurs to reduce greenhouse gas emissions to within the allowable limits for each industry. These numerous measures indicate a regulatory framework specific to member states, but when implemented, they have also impacted stakeholders outside the member countries. For instance, the Carbon Border Adjustment Mechanism (CBAM) requires importers of goods from outside the European Union to pay compensation for excess carbon beyond what is permitted for each industry group. In reality, these measures affect Thai exporters in sectors subject to CBAM as well, not just in European Union countries, but other regions such as the United States, China, and the United Kingdom are also creating similar conditions, regulations, and standards.

As for Thailand, activities regarding climate change are increasingly visible, including the establishment of greenhouse gas emission assessment mechanisms and certification systems, as well as the creation of a voluntary greenhouse gas emission compensation mechanism, the establishment of the Department of Climate Change, and most recently, the proposal of the Climate Change Act, which officially marks the first issuance of climate change regulations in Thailand. This proposed act has already gone through public consultation and will soon proceed with the legal process for enactment.

The key points of the proposed act stipulate that government agencies must create a national greenhouse gas database, covering emissions, sequestration, absorption, and guidelines for reducing greenhouse gas emissions (Section 26). Furthermore, this act grants government agencies the authority to request information from stakeholders who possess such data (Section 27), which also encompasses industrial entrepreneurs. However, the information provided by agencies or organizations remains confidential and prohibits disclosure that could harm the data owners (Sections 29 and 30).

After acknowledging the information, government agencies must develop a national greenhouse gas reduction action plan, setting policies, budgets, and monitoring procedures to ensure that greenhouse gas emission reduction operations adhere to the established plans or policies. Additionally, the government must promote activities related to climate change in terms of budget, knowledge, and technology, to align with the submission of greenhouse gas emission data, including activities aimed at reducing the country's greenhouse gas emissions.

Importance for Thai Entrepreneurs
The proposed Climate Change Act, combined with the climate change measures implemented by foreign countries, requires entrepreneurs to be involved. It is likely that the establishment of Thailand's climate change measures and operations may be influenced by concepts from foreign countries that could be adapted. For instance, carbon compensation measures that require entrepreneurs emitting more carbon than stipulated to take responsibility by improving their business processes to reduce greenhouse gas emissions. Alternatively, if compliance is not possible, they may need to rely on carbon market mechanisms or purchasing carbon credits, as well as carbon taxation on products that have high greenhouse gas emissions. Undoubtedly, various measures will impact the populace due to increased operational costs.

However, considering the various measures that are about to arise, they may be unavoidable for Thai entrepreneurs to maintain market presence. If no appropriate mechanisms are established, Thai entrepreneurs may suffer trade disadvantages and might be perceived as lacking a serious role and measures in addressing global problems. Thus, stakeholders from all sectors should collaborate to devise supportive measures and adjust operational models to minimize the impact on the populace.
