เมื่อวันที่ 31 กรกฎาคม 2568 สภาอุตสาหกรรมแห่งประเทศไทย (ส.อ.ท.) นำโดยนายอภิชิต ประสพรัตน์ รองประธาน ส.อ.ท. และประธานสถาบันวิสาหกิจขนาดกลางและขนาดย่อมอุตสาหกรรมการผลิต (SMI) ได้หารือร่วมกับนายกิตติวัฒน์ ปัจฉิมนันท์ รองอธิบดีกรมทรัพย์สินทางปัญญา เพื่อผลักดันการคุ้มครองทรัพย์สินทางปัญญาให้กับผู้ประกอบการภาคการผลิต ณ ห้องประชุม 1015 ชั้น 10 ส.อ.ท.
ส.อ.ท. ได้เสนอประเด็นปัญหาจากสมาชิก ซึ่งได้รวบรวมทั้งจากกลุ่มอุตสาหกรรมและสภาอุตสาหกรรมจังหวัด ที่เกี่ยวข้องกับการขอจดการคุ้มครองด้านทรัพย์สินทางปัญญาประเภทต่างๆ อาทิ
- ปัญหาขั้นตอนการยื่นขอจด
- ระยะเวลาการตรวจสอบและอนุมัติ
- การละเมิดและลอกเลียนและการบังคับใช้สิทธิ์ รวมถึงช่องทางการแจ้งสินค้าละเมิดลิขสิทธิ์
- การสืบค้นข้อมูลก่อนยื่นจด
- ระบบการตรวจสอบความคืบหน้าของการยื่นขอ
ทั้งนี้ ส.อ.ท. ได้นำเสนอข้อเสนอแนะ เพื่อส่งเสริมภาคอุตสาหกรรมให้ยื่นขอการคุ้มครองด้านทรัพย์สินทางปัญญาได้มากขึ้น ดังนี้
1. จัดอบรมหรือให้ความรู้เรื่องทรัพย์สินทางปัญญาแก่ผู้ประกอบการภาคการผลิตให้มีความรู้ความเข้าใจมากขึ้น โดยดำเนินการร่วมกับ ส.อ.ท. อย่างต่อเนื่อง และในรูปแบบที่เข้าใจง่ายต่อสมาชิก ส.อ.ท.
2. ปรับระบบสืบค้นข้อมูลด้านทรัพย์สินทางปัญญาให้เข้าใจได้ง่าย ไม่ซับซ้อน รวมถึงระบบการแจ้งเตือน/ติดตาม ความคืบหน้าการยื่นขอ
3. จัดทำคลินิกให้คำปรึกษาเรื่องการขอยื่นจดประเภทต่างๆ การกรอกข้อมูลในแบบคำขอให้สมบูรณ์ ปัญหาในการถูกละเมิดทรัพย์สินทางปัญญา ทั้งการยื่นขอจดภายในประเทศและการยื่นขอจดในต่างประเทศ
4. จัดทำ Guidebook สำหรับสินค้าประเภทต่างๆ เพื่อให้ผู้ประกอบการเข้าใจถึงประเภททรัพย์สินทางปัญญาที่ควรจด
5. เสนอให้กรมฯ แสดงข้อมูลการยื่นขอจดทรัพย์สินทางปัญญาแต่ละประเภท โดยแยกรายอุตสาหกรรม และแยกสินค้าไทยหรือต่างประเทศ เพื่อทราบความเคลื่อนไหวของธุรกิจในแต่ละเดือน
ทั้งนี้ กรมทรัพย์สินทางปัญญาได้รับข้อเสนอทั้งหมด เพื่อวางแผนการทำงาน ซึ่งหลังจากนี้จะได้มีการทำงานร่วมกันในแต่ละข้อเสนอต่อไปอย่างใกล้ชิด
On July 31, 2025, the Federation of Thai Industries (FTI), led by Mr. Apichit Prasoprat, Vice President of FTI and President of the Small and Medium-Sized Enterprises Institute of Manufacturing Industry (SMI), discussed with Mr. Kittiwat Pajimanan, Deputy Director-General of the Department of Intellectual Property, to push for intellectual property protection for operators in the manufacturing sector at meeting room 1015, 10th floor, FTI.
FTI raised issues from its members, gathering concerns from both industry groups and provincial industry councils regarding the process of applying for various types of intellectual property protection, such as
- Issues regarding the application submission process
- Time taken for examination and approval
- Infringement and plagiarism issues and the enforcement of rights, including channels for reporting copyright infringement products
- Information searching before filing
- System for checking the progress of applications
In this regard, FTI has proposed recommendations to promote the industrial sector to apply for intellectual property protection more actively, as follows:
1. Organize training or provide knowledge on intellectual property to manufacturers to improve their understanding, by collaborating continuously with FTI and in formats that are easy for FTI members to comprehend.
2. Adjust the intellectual property information search system to make it easy to understand and not complicated, including a monitoring system for application progress.
3. Establish a clinic to provide consultation on various types of registrations, help in completing application forms and address issues regarding intellectual property infringement, both for domestic applications and applications abroad.
4. Create a guidebook for various types of products to help operators understand the types of intellectual property they should register.
5. Recommend the Department to present the application information for registration of intellectual property by industry and differentiate between Thai and foreign products, to provide insights into business movements each month.
The Department of Intellectual Property has received all suggestions to plan its operations, and will continue to work closely on each proposal going forward.
