เมื่อวันที่ 22 เมษายน 2568 ส.อ.ท. จัดประชุมด่วนร่วมกับนายกรัฐมนตรีและกระทรวงพาณิชย์ เพื่อหารือแนวทางป้องกันการสวมสิทธิ์สินค้าไปสหรัฐฯ โดยมีการพิจารณาให้กรมการค้าต่างประเทศเป็นหน่วยงานเดียวในการออกหนังสือรับรองสินค้าฯ ที่เฝ้าระวัง และมอบหมายความร่วมมือจากทุกฝ่ายในช่วง 90 วันข้างหน้าเพื่อแก้ไขปัญหาอย่างมีประสิทธิภาพOn April 22, 2025, FTI held an urgent meeting with the Prime Minister and the Ministry of Commerce to discuss measures to prevent product misappropriation to the U.S. It was proposed that the Department of Foreign Trade solely issue certificates for monitored products, with a call for cooperation from all parties over the next 90 days to effectively resolve the issue.

เมื่อวันอังคารที่ 22 เมษายน 2568 นายเกรียงไกร เธียรนุกุล ประธานสภาอุตสาหกรรมแห่งประเทศไทย (ส.อ.ท.) มอบหมายให้นายนาวา จันทนสุรคน รองประธาน ส.อ.ท. เข้าร่วมการประชุม เรื่องการป้องกันการสวมสิทธิ์สินค้าเฝ้าระวังไปสหรัฐอเมริกา ร่วมกับนางสาวแพทองธาร ชินวัตร นายกรัฐมนตรี และนายวุฒิไกร ลีวีระพันธุ์ ปลัดกระทรวงพาณิชย์ พร้อมทั้งหน่วยงานจากกระทรวงพาณิชย์ กรมศุลกากร หอการค้าไทยและสภาหอการค้าแห่งประเทศไทย ณ ทำเนียบรัฐบาล

 

กระทรวงพาณิชย์ แจ้งว่าการส่งออกสินค้าเฝ้าระวังไปยังสหรัฐฯ ต้องใช้หนังสือรับรองถิ่นกำเนิดสินค้า Form C/O ทั่วไป โดยปัจจุบันประเทศไทยมีหน่วยงานที่สามารถออกหนังสือรับรองฯ Form C/O ทั่วไป รวมทั้งสิ้น 3 หน่วยงาน ได้แก่ (1) กรมการค้าต่างประเทศ กระทรวงพาณิชย์ (2) หอการค้าไทยและสภาหอการค้าแห่งประเทศไทย และ (3) สภาอุตสาหกรรมแห่งประเทศไทย โดยปัญหาที่เกิดขึ้นในปัจจุบัน พบว่า มีการนำเข้าสินค้าจากต่างประเทศมาผ่านไทย เพื่อส่งออกไปสหรัฐฯ โดยใช้หนังสือรับรองฯ ของไทย ซึ่งประเด็นดังกล่าวเป็นข้อกังวลของสหรัฐฯ โดยที่ประชุมได้เสนอแนวทางการดำเนินการแก้ไข ดังนี้

 

1. มอบกรมการค้าต่างประเทศ กระทรวงพาณิชย์ เป็นหน่วยงานออกหนังสือรับรองฯ Form C/O ทั่วไป สำหรับสินค้าเฝ้าระวังไปสหรัฐฯ เพียงหน่วยงานเดียว
2. กรมค้าต่างประเทศ กระทรวงพาณิชย์ จะดำเนินการปรับปรุงกระบวนการการตรวจสอบก่อนออกใบรับรอง โดยมีการตรวจโรงงานอย่างละเอียดและตรวจเอกสารการส่งออกอย่างเข้มงวด สำหรับสินค้าที่มีความเสี่ยงสูง โดยจะดำเนินการบูรณาการร่วมกับกรมโรงงาน กระทรวงอุตสาหกรรม และหน่วยงานที่เกี่ยวข้อง
3. กรมการค้าต่างประเทศได้หารือกับศุลกากรสหรัฐฯ (U.S. Customs and Border Protection: CBP) ถึงข้อกังวลและแนวทางดำเนินการร่วมกัน โดยจะจัดทำเป็นแนวทางการทำงานและการตรวจสอบร่วมกัน เพื่อให้ศุลกากรสหรัฐฯ ยอมรับการตรวจสอบของประเทศไทย นอกจากนั้น ศุลกากรสหรัฐฯ จะอบรมให้แก่เจ้าหน้าที่ที่เกี่ยวข้องของไทยต่อไป
4. ท่านนายกรัฐมนตรีได้ขอความร่วมมือหน่วยงานทุกหน่วยงานที่เกี่ยวข้องทั้งหน่วยงานภาครัฐและภาคเอกชนให้ร่วมมือกันแก้ปัญหาในช่วงระยะเวลา 90 วันนี้ให้แล้วเสร็จ และให้หาแนวทางในอนาคตที่จะมีการป้องกันสินค้าที่จะมาสวมสิทธิ์แล้วส่งออกไปยังประเทศปลายทางอื่นๆ เนื่องจากกฎหมายที่ผ่านมา อาจจะล้าสมัยหรือไม่ได้ครอบคลุมการดำเนินการที่ผิดปกติหรือผิดกฎหมายดังเช่นปัจจุบัน

 

นายนาวา นำเสนอต่อที่ประชุมว่า ส.อ.ท. โดยสายงานสมาชิกสัมพันธ์ และที่ประชุมกรรมการบริหาร ส.อ.ท. เห็นพ้อง และยินดีให้ความร่วมมือกับกระทรวงพาณิชย์เพื่อป้องกันการสวมสิทธิ์ดังกล่าว และแจ้งข้อมูลว่าการออกหนังสือรับรองถิ่นกําเนิดสินค้า (Certificate of Origin : C/O) ทั่วไปของส.อ.ท. ที่ผ่านมาไม่เคยพบว่าเป็นรายที่กรมศุลกากรของสหรัฐฯ สุ่มตรวจพบว่ามีการสำแดงเท็จแต่อย่างใด

 

นอกจากนี้ ส.อ.ท. เรียนเสนอต่อนายกรัฐมนตรี และกระทรวงพาณิชย์ พิจารณาดำเนินมาตรการดังนี้
1. ขอให้กรมการค้าต่างประเทศอำนวยความสะดวกในการออก C/O ทั่วไปสินค้าเฝ้าระวัง โดยไม่กระทบต่อการอำนวยความสะดวกแก่ผู้ส่งออกของไทย และที่สำคัญที่สุด สำหรับผู้ส่งออกไทยที่ปฏิบัติถูกต้องอยู่แล้วจะต้องสามารถได้รับ C/O ทั่วไปอย่างรวดเร็ว มีประสิทธิภาพเช่นเดิม
2. ขอให้กระทรวงพาณิชย์จัดทีมตรวจติดตามอย่างเข้มข้น เพื่อคัดกรองผู้กระทำผิด หลบเลี่ยงไม่ปฎิบัติตามกฎหมายของกระทรวงพาณิชย์ หรือบูรณาการกับกระทรวงอื่นๆ ตามกฎหมายของหน่วยงานนั้นๆ เพื่อดำเนินคดีกับผู้กระทำความผิดเพื่อมิให้เป็นเยี่ยงอย่างต่อไป
3. ในระยะยาว กระทรวงพาณิชย์ควรทบทวนกฎหมายที่เกี่ยวข้อง โดยเฉพาะบทลงโทษให้เข้มข้นมากขึ้น

On Tuesday, April 22, 2025, Mr. Kriangkrai Thiennukool, Chairman of the Federation of Thai Industries (FTI), assigned Mr. Nava Chanthanasurakorn, Vice Chairman of the FTI, to attend a meeting on preventing trademark infringement for exports to the United States, along with Ms. Paethongtarn Shinawatra, the Prime Minister, and Mr. Wuttikrai Leewiraphan, Permanent Secretary of the Ministry of Commerce, as well as representatives from the Ministry of Commerce, the Customs Department, the Thai Chamber of Commerce, and the Federation of Thai Chambers of Commerce at Government House.

 

The Ministry of Commerce reported that exports of goods under surveillance to the United States require a Certificate of Origin Form C/O. Currently, there are three agencies in Thailand authorized to issue the Certificate of Origin Form C/O, comprising (1) the Department of Foreign Trade, Ministry of Commerce, (2) the Thai Chamber of Commerce and the Federation of Thai Chambers of Commerce, and (3) the Federation of Thai Industries. The current issue observed is that goods from abroad are imported through Thailand for export to the United States using Thai Certificates of Origin, which is a concern for the United States. The meeting proposed the following corrective measures:

 

1. Designate the Department of Foreign Trade, Ministry of Commerce, as the sole issuing authority for the Certificate of Origin Form C/O for goods under surveillance for export to the United States.
2. The Department of Foreign Trade, Ministry of Commerce, will improve the verification process before issuing certificates, including detailed factory inspections and strict document checks for high-risk goods, collaborating with the Department of Industry, Ministry of Industry, and relevant agencies.
3. The Department of Foreign Trade has discussed with the U.S. Customs and Border Protection (CBP) regarding their concerns and joint operational guidelines, establishing a framework for joint inspections to ensure that U.S. Customs accepts Thailand's inspections. Furthermore, the U.S. Customs will provide training to relevant Thai officials.

 

The Prime Minister requested cooperation from all relevant agencies, both public and private sectors, to collaboratively resolve this issue within 90 days and to find future measures to prevent goods from being misrepresented before being exported to other destination countries, as previous laws may be outdated or inadequate to cover irregular or illegal activities as we see today.

 

Mr. Nava presented to the meeting that the FTI, through its member relations department and the Executive Committee meeting, unanimously agrees to cooperate with the Ministry of Commerce to prevent such trademark infringement and noted that there has never been a case where the Certificate of Origin issued by the FTI has been found to contain false declarations by U.S. Customs during random inspections.

 

Moreover, the FTI submits proposals to the Prime Minister and the Ministry of Commerce to consider implementing the following measures:
1. Request the Department of Foreign Trade to facilitate the issuance of general Certificates of Origin for surveillance goods without affecting the convenience for Thai exporters. Importantly, exporters adhering to the law should be able to receive general Certificates of Origin promptly and efficiently, as before.
2. Request the Ministry of Commerce to intensify monitoring teams to screen violators who evade compliance with the Ministry of Commerce's regulations or integrate with other ministries as per their regulations to prosecute offenders and prevent future malpractice.
3. In the long term, the Ministry of Commerce should review related laws, especially penalties, to ensure they are more stringent.
